PERFORM MEDIA SERVICES ('Perform') ON BEHALF OF Tennis Australia Limited ('Tennis Australia') RESERVE THE RIGHT, AT ANY TIME, TO MODIFY THESE CONDITIONS BY POSTING A REVISED VERSION ON THIS WEBSITE. YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD (AND AGREE TO BE BOUND BY) THESE CONDITIONS NOW AND EVERY TIME YOU USE THE SERVICES. BY CONTINUING TO USE THE SERVICES YOU ACCEPT ANY REVISED VERSION.

1. Orders
In ticking the box and accepting the T&C's on the registration page, you are entering into a legally binding contract with Perform and Tennis Australia to purchase the Services. The contract is conditional on payment being authorised by your card issuer and is at all times subject to these Conditions.

2. Price and Payment
Our prices only cover access to the Services. Telephone line and other communications or access costs may be charged to you separately by your ISP or relevant service provider. All our prices are inclusive of UK VAT at the rates in force from time to time. Except in the case of manifest error, the prices payable for the Services that you order are as set out on this website at the time at which you place your order.
Payment for services must be made by Mastercard, Visa, Switch, Solo Visa Delta and JCB cards. You confirm that the credit/debit card which is being used is yours. All credit/debit card holders are subject to validation checks and authorisation by the card issuer.
Perform. reserves the right to refuse credit/debit card payments in its reasonable discretion. NetBanx will process your payment on a secure site.

3. Duration and Termination
Our right to terminate
Perform. may terminate this agreement with immediate effect and by written notice at any time if you commit a material breach of this agreement (and any breach of clause 2 or 6 will be considered to be a material breach) or if you do not fulfil any of the technical requirements set out in clause 4.
In addition, Perform. may terminate this agreement on one calendar month's notice given in writing to you in accordance with clause 5. If Perform. terminates the agreement other than as a result of your breach or technical non-compliance, you will receive a refund of the amount you pre-paid for the Services less an amount proportionate to the number of days for which you have had access to the Services.

4. The Services and Service Availability
The 'Services' shall be the provision to you of access to services on this Website including Live feeds from 6 courts, Highlights, Interviews & Features and Classic Moments from past Australian Opens.
However Perform. reserves the right to amend the nature and extent of the Services available at any time. You will need to load your PC with Windows Media Player software (which you will need to obtain).
You are responsible for ensuring that you have and maintain all the hardware and software necessary to access, receive and view the Services.
In the event that Perform reasonably determines that you do not meet these requirements Perform. reserves the right to refuse the provision of Services to you. In such a case you will be entitled to a refund of any sums paid as provided for in clause 3 ("Our right to terminate").
Perform. will use its reasonable endeavours to ensure that the Services are made available to you at all times. However, this Website is provided on an "as is" basis.
In particular, the image and sound quality of the Services may vary, whether due to congestion on the internet or telephone lines or otherwise. The Website may not be uninterrupted, timely, secure or error-free.
From time to time we will need to close the website to carry out upgrades or maintenance. We will try to keep this to a minimum. Subject to the constraints described above, Perform. will carry out the Services with reasonable care and skill. Apart from this we make no representation or warranty (and exclude all warranties and conditions otherwise implied, to the fullest extent permitted by law).
This does not affect any other statutory rights you may have as a consumer.

You can contact Perform. whether to discuss technical problems or trace your subscription, or for any other reason by emailing to Perform. as described below. Any notice given by Perform. can be given by post or email to the most recent postal or email address we hold for you. Transmission or postal failures are at your risk, and we cannot be responsible for non-receipt of messages we send you.

6. Your use of the Services
The design, text, graphics, footage, images and other feed you receive (and any selection or arrangement) are subject to the copyright of Perform and others, including Tennis Australia.
You agree that you will:
(a) use the Services for non-commercial purposes only without making any gain and that you will not permit any other person or persons to use the Services. This means, for example, that you must not charge for viewing of the Services and that you cannot use the Services to attract others to buy goods or Services from you or anyone else;
(b) at any given time, only view the Services via your permitted PC and never permit any other person to access the Services. You must keep your password secure and never share passwords or other access codes with anyone or in any way make them accessible to others;
(c) not copy, record or store all or any part of the Services (other than on a purely transitory basis to permit you to view them) or divert, re-transmit or otherwise distribute all or any part of the Services to any person, or authorise, enable or procure any other person to do any of the above;
(d) not alter, disassemble, decompile or reverse engineer any part of the Services;
(e) not view the Services in circumstances where members of the public can view them simultaneously or authorise, enable or procure any other person to do so; and

AND 'TENNIS AUSTRALIA TO YOU ARISING BY REASON OF OR IN CONNECTION WITH THE SUPPLY OF THE SERVICES TO YOU SHALL BE LIMITED TO THE AMOUNT PAID BY YOU IN RESPECT OF THE SERVICES IN QUESTION ("PAYMENT AMOUNT"). NEITHER PREMIUM TV Ltd. NOR TENNIS AUSTRALIA SHALL IN ANY EVENT BE LIABLE TO YOU FOR:
(I) ANY DIRECT LOSS IN EXCESS OF THE SUBSCRIPTION AMOUNT; OR
(II) ANY CORRUPTION TO DATA OR ANY INDIRECT OR CONSEQUENTIAL LOSS WHATSOEVER EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR SHOULD REASONABLY KNOW OF SUCH LOSS. NOTHING IN THESE CONDITIONS SHALL EXCLUDE OR LIMIT THE LIABILITY OF PERFORM. AND TENNIS AUSTRALIA FOR DEATH OR PERSONAL INJURY DUE TO ITS NEGLIGENCE OR FOR ITS FRAUD. 8. Data Protection and Privacy
It is good practice, and it is your responsibility, to take adequate steps to protect against viruses and such like. The information and data ("personal data") which is provided by you in connection with this site will be held on the computers and manual records of, and will be used by, Perform, TENNIS AUSTRALIA and its sponsors, affiliates, official suppliers and any other reputable suppliers of goods and services which Perform or Tennis Australia believe may be of interest to you (together "the companies"). A complete list of all such companies is available on request from the address below. Your personal data will only be disclosed to other entities with your prior consent or where permitted or required by law.
The personal data shall be used by the companies for the following purposes:
(i) to update and develop the companies' records and for assessment and analysis including market and product analysis;

9. Force Majeure
Neither Perform. nor TENNIS AUSTRALIA shall have any liability to you for any delay or failure to deliver the Services to the extent that such delay or failure to deliver arises from causes beyond the reasonable control of Perform. or TENNIS AUSTRALIA including, but not limited to, the failure of electronic or mechanical equipment or communication lines, third party action (including denial of service attack and overuse or misuse of the Services), telephone or other inter connect problems, computer viruses, unauthorised access, theft, operator errors, fire, severe weather conditions, including floods, acts of God, acts or regulations of any regulatory, governmental or supranational authority, war, terrorist act, riot, strike, lock-out, industrial disputes and the cancellation or postponement.
If this means that you fail to receive a substantial element of the Services Perform. will refund such proportion of the sum pre-paid by you in respect of the Services as it decides, acting reasonably, is fair in the circumstances.

10. Waiver
No failure to exercise or delay in exercising any right, powers or remedy by either of Perform or TENNIS AUSTRALIA shall be construed or operate as a waiver of any rights or remedies, or of any subsequent breach of any provision of these Conditions. A single or partial exercise of any right, power or remedy does not preclude any other or further exercise of that or any other right, power or remedy. A waiver is not valid or binding on the party granting that waiver unless made in writing.

11. Entire Agreement
These Conditions together with the current Services prices and contact details on this website, set out the whole of the agreement between you and Perform This agreement cannot be changed or terminated orally, and no changes or amendments to this agreement shall be binding upon the parties until confirmed in writing by Perform
Perform employees or agents are not authorised to make any representations concerning the Services unless confirmed in writing by Perform You confirm that you do not rely on, and waive any claims for breach of, any such representations that are not so confirmed.

12. Governing Law
These Conditions shall be exclusively governed by and construed in accordance with the laws of England and you irrevocably submit to the exclusive jurisdiction of the courts of England

In Windows Media Player go to Tools\Options\

On the "File Types" tab "Select All"and click "OK"

On the "Security" tab Tick "Run script commands when present"

On the "Privacy" tab Tick "Acquire licenses automatically for protected content"

On the "Performance" tab ensure 'Detect Connection Speed' is set and ensure 'Use Default Buffering' is set

On the "Play" menu adjust Volume to suit your taste.

On the "Player" tab Tick "Download codecs automatically"

On the "Network" tab "Select all protocols"

In the "Streaming Proxy settings" Configure:

HTTPProxy = Browser

MMSProxy = Autodetect

RTSPProxy = Autodetect

See if the Player is set to work offline, click the File menu in the Player to verify if a check mark is displayed next to the Work Offline command. If it is, to clear the check mark and enable the Player to connect to the network, click Work Offline.

Note that if you are trying to play the file from a computer in your office, your corporate network administrator may prevent the Player from accessing the Internet, even if you remove the check mark next to Work Offline. In this case, contact your network administrator for more information.

If you want to continue to work offline but allow Windows Media Player (Windows Media Player 9 Series or later) to connect to the Internet when it needs to, you can do the following:

In the Player, on the Tools menu, click Options.

In the Options dialog box, on the Player tab, click Connect to the Internet (overrides other commands).

Some video adaptors cannot play audio content that was created by using an 8-kilohertz (kHz) or 16-kHz sampling rate. To determine whether this is the problem, determine the sampling rate that is used in the Advanced Systems Format (.asf) file. To do this, follow these steps:

a. In Windows Media Player, open the streaming media file that is causing problems.

b. On the File menu, click Properties.

c. Click the Advanced tab.

d. Examine the list of codecs being used to see if you can determine the sampling rate for the audio. If the rate is 8 kHz or 16 kHz, this may be the problem.

AUDIO DEVICES

Follow these steps to confirm that you have video adaptor or a sound card and that you have a correct driver.

1Click Start, point to Settings, click Control Panel, and then double-click System.

2.On the Device Manager tab, double-click the Sound, video and game controllers branch to expand it.

3.Click the sound card or the video adaptor, and then click Properties.

4.On the Driver tab, click Update Driver, and then click Next.

5.Click Display a list of all the drivers..., and then click Next.

6.Click Show All Hardware, click the appropriate manufacturer and the model in the Manufacturers and Models boxes, and then click Next. If the appropriate device is not listed, click Have Disk, and install the correct driver from the manufacturer's installation disk. If you receive a message that states that the current driver may be a closer match for your hardware than the driver that you have selected, click Yes.

Click Next, click Finish, and then click Yes to restart your computer.

Check for updates for the driver by accessing your Video Card manufacturers web site.

Some video cards on Windows 98 computers may cause unexplained program crashes either when starting programs or when selecting menu choices. The crash (access violation) is caused by an older driver that is not compatible with Windows 98. You need to update your video driver. A video driver is the software used to communicate between Windows and your video card and monitor.

Switching the video display to VGA will help determine if the video drivers on your computer are corrupted or conflicting with the application.

How to Identify your Video Card and Current Driver

On your screen, locate and click the Start button. From the Start menu, point to Settings, then click Control Panel. In Control Panel, double-click the Display icon.

Select "Settings".

Click the "Advanced" button.

Click the "Adapter" tab.

The name of the video card, manufacturer, version number, and the filenames of the drivers are displayed. Write this information down so you have information available in case anything goes wrong.

Either: Check for updates for the driver by accessing your Video Card manufacturers web site.

Or on the Adapter tab, click "Change".

In the Update Device Driver Wizard dialog box, click "Next".

In the next dialog box, click "Next" to allow the Wizard to search for updated drivers.

VIDEO CODECS

Make sure that the waveform-audio driver or audio codec is listed; to verify this, in Control Panel, double-click Sounds and Multimedia click the Hardware tab, and then examine the Devices list. Check with the manufacturer of the sound card to ensure you have the proper drivers. If you cannot find the correct audio codec or driver for the sound card in the list, connect to the manufacturer's Web site and download a current driver.

If you're having problems viewing video you may need to download and install the necessary codecs (compression software) on top of your Windows Media Player.

Move the Volume slider left to decrease or right to increase the volume level.

To see whether your browser is configured to use the Java Runtime Environment (JRE) or not, first open the Windows Control Panel. From the Start menu button, select Settings, then Control Panel to open the Control Panel. You should see the Java Coffee Cup logo icon in the Control Panel.

See if the Player is set to work offline, click the File menu in the Player to verify if a check mark is displayed next to the Work Offline command. If it is, to clear the check mark and enable the Player to connect to the network, click Work Offline.

Note that if you are trying to play the file from a computer in your office, your corporate network administrator may prevent the Player from accessing the Internet, even if you remove the check mark next to Work Offline. In this case, contact your network administrator for more information.

If you want to continue to work offline but allow Windows Media Player (Windows Media Player 9 Series or later) to connect to the Internet when it needs to, you can do the following:

In the Player, on the Tools menu, click Options.

In the Options dialog box, on the Player tab, click Connect to the Internet (overrides other commands).

Some video adaptors cannot play audio content that was created by using an 8-kilohertz (kHz) or 16-kHz sampling rate. To determine whether this is the problem, determine the sampling rate that is used in the Advanced Systems Format (.asf) file. To do this, follow these steps:

a. In Windows Media Player, open the streaming media file that is causing problems.

b. On the File menu, click Properties.

c. Click the Advanced tab.

d. Examine the list of codecs being used to see if you can determine the sampling rate for the audio. If the rate is 8 kHz or 16 kHz, this may be the problem.

VIDEO DEVICES

To locate your Video Card information please use the following steps;

Start > Settings > Control Panel > Display

Select the "Settings" tab

Click on the "Advanced" button

On the new window select "Adapter" tab and click "Properties"

Select the "Driver" tab and click "Update Driver"

Follow the instructions in the "Wizard".

When asked to "Search the following hardware devices" select "Microsoft Windows Update"

This will allow you to access the Video Card information from the Hardware Tab.

VIDEO CODECS

Make sure that the waveform-audio driver or audio codec is listed; to verify this, in Control Panel, double-click Sounds and Multimedia click the Hardware tab, and then examine the Devices list. Check with the manufacturer of the sound card to ensure you have the proper drivers. If you cannot find the correct audio codec or driver for the sound card in the list, connect to the manufacturer's Web site and download a current driver.

If you're having problems viewing video you may need to download and install the necessary codecs (compression software) on top of your Windows Media Player.

To configure audio performance options

1.In Control Panel, double-click Sounds and Multimedia.

2.Click the Audio tab, and then under Sound Playback or Sound Recording, click Advanced.

3.Click the Performance tab, and then under Audio playback or Audio recording, select the hardware acceleration and sample rate conversion quality settings for the workstation.

VIDEO DEVICES

To locate your Video Card information please use the following steps:

Start > Settings > Control Panel > Display

Select the "Settings" tab

Click on the "Advanced" button

On the new window select "Adapter" tab and click "Properties"

Select the "Driver" tab and click "Update Driver"

ollow the instructions in the "Wizard".

When asked to "Search the following hardware devices" select "Microsoft Windows Update"

This will allow you to access the Video Card information from the Hardware Tab.

VIDEO CODECS

Make sure that the waveform-audio driver or audio codec is listed; to verify this, in Control Panel, double-click Sounds and Multimedia click the Hardware tab, and then examine the Devices list. Check with the manufacturer of the sound card to ensure you have the proper drivers. If you cannot find the correct audio codec or driver for the sound card in the list, connect to the manufacturer's Web site and download a current driver.

If you're having problems viewing video you may need to download and install the necessary codecs (compression software) on top of your Windows Media Player.

MULTIMEDIA

If the broadcast volume does not improve can you please check you system settings:

Start > Settings > Control Panel > Sounds and Multimedia

Windows Media Player > Play > Volume.

To adjust the volume

Move the Volume slider left to decrease or right to increase the volume level.

-Or-

On the Play menu, point to Volume, and then click Up, Down, or Mute.

Note

To turn audio off, click the Mute button. To turn audio back on, click the button again.

To adjust the graphic equalizer levels

Click Now Playing.

On the View menu, point to Enhancements, and then click Graphic Equalizer.

DirectX Diagnostic Tool

Windows XP includes the DirectX Diagnostic Tool, a utility for diagnosing problems with DirectX drivers and multimedia hardware. You can use the tool to obtain detailed system and driver information, as well as to test specific devices. The results can be reported to Microsoft Product Support Services to speed up diagnosing and resolving problems. To display the DirectX Diagnostic Tool, on the Start menu, click Run, and then type:

To see whether your browser is configured to use the Java Runtime Environment (JRE) or not, first open the Windows Control Panel. From the Start menu button, select Settings, then Control Panelto open the Control Panel. You should see the Java Coffee Cup logo icon in the Control Panel.

Double-click the icon to open the Java Control Panel.

In the Java Control Panel, click the "Advanced" tab.

Under Settings, click on + icon against <Applet> tag support.

Make sure the box next to Internet Explorer, Netscape, or Mozilla is checked.

If it is not checked, click the checkbox to enable the JRE for your Web browser.

Click Apply.

If you do not see the coffee cup icon in the Windows Control Panel, you do not have the latest version of the Sun JRE installed on your computer.

ACCESS PROBLEMS

If you have registered on the site but your username or password are not accepted, please check the following;

The password storing mechanism within Internet Explorer can occasionally corrupt passwords, and it is sometimes necessary to clear your stored password and re-enter the information. This can be done as follows:

1. Within Internet Explorerclick on the Tools menu and select Internet Options.

2. Select the Content tab, and click on the Auto Complete button.

3. Click the Clear Password button, and ok the confirmation.

4. Click OKto exit Internet Options

5. Close all instances of Internet Explorer.

The changes will take effect the next time you start Internet Explorer

When I access the site, I am repeatedly told to enable Cookies (IE6)

Cookies are small files, stored on your computer and used to authenticate you after you have logged in initially. If you do not permit Cookies from Barnsley World to be stored on your local computer, you will not be able to gain access to the site.

To enable Cookies in Internet Explorer 6, you should:

1. Start Internet Explorer.

2. Select the Tools menu and then Internet Options.

3. In the next window select the Privacy tab at the top of the screen.

4. Click on the Default button at the bottom right of this section.

5. Now drag the slider on the left of this section to the bottom - until you see the Accept All Cookies message.

6. Click the OK button at the very bottom of the window to accept your changes.

7. Stop all instances of Internet Explorer to ensure settings are applied properly.

DRM Problems

Digital Rights Management software has been applied to the Australian Open content to protect the footage from being copies or shared over the internet. Your computer will be granted a set number of licences to view the content. It is advisable not to log onto the site on more than four different computers.

If you attempt to view content on the site but are told that 'the number of licences have been exceeded' then you should email our customer service so that they can re-set the number of licences on your account.

If the problem still persists then this indicates that your computer software (Windows Media Player or Internet Explorer) is either out of date or corrupted, or your system set up needs reconfiguring. To rectify this problem you should then follow the advice contained in these pages on updating your software or changing your system settings.
